In 1966 the petitioner, William Pantle, was employed by the Board of Trustees of the University of Illinois. On April 28, 1970, he was working in the elevator at the feed storage plant of the University Farms at the Champaign-Urbana campus. On that date he was struck in the left eye by a kernel of corn thrown from a hammermill. As a result of this accident he lost the sight in his left eye. On May 22, 1972, the petitioner filed an application for adjustment of claim with the Industrial Commission. The respondent filed a motion to dismiss the application because it had not been filed within one year after the accident as required by section 6(c)(3) of the Workmen's Compensation Act (Ill. Rev. Stat. 1971, ch. 48, par. 138.6(c)(3)). The motion also alleged that the respondent had made no payment to the petitioner because of this injury, and an affidavit was filed in support of this allegation.
